The Conveyancing Process.

* Purchasing *

Once you have decided to purchase a property you will need to engage a Licensed Conveyancer or Solicitor to carry out the legal process.  At Conveyancing First we will ensure that your transaction is carried out in a timely manner and help you to secure  your dream home or investment property.

The procedure for purchasing a property. 

Pre-Exchange

  • Take instructions
  • Review contract for sale
  • Order pest, building, and Strata Reports as required
  • Request amendments to the contract
  • Liaise with your lender to ensure that you have loan approval
  • Advice you on the contract
  • Advice Stamp Duty liability



You Make An Offer

Exchange

  • Ensure Contract has been agreed by both parties
  • Have you sign the contract
  • Make an appointment with the Vendor's Conveyancer or Solicitor to exchange contracts where both contracts are identical, signed and dated the date of exchange

Post Exchange

  • Order all inquiries
  • Assist in First Home buyers stamp duty exemption (if applicable).
  • Liaise with your lender to ensure that finance will be available for settlement.
  • Prepare settlement figures and book in settlement with your lender and the vendor's Conveyancer or Solicitor
  • Prepare the Transfer and have the contract stamped
  • Provide you with settlement statement and cheque details for settlement.

Settlement and Post Settlement

  • Attend settlement
  • Attend to any registration of title
  • Contact the agent to advise that settlement is completed.
  • Arrange for the agent to release the keys to you
  • Advice the relevant authorities of your purchase
  • Forward to you final copies of documents for your records.

Once you have decided to sell your property Conveyancing First will obtain certain information about the property such as the address and details of any inclusions & exclusions.  We need details of any building work or other alterations to the property that may require Home Owners Warranty Insurance together with a
building certificate and an applicable building certificate and the like.

The procedure for selling a property.

Prepare Contract

  • Take instructions from you
  • Prepare Contract for sale with all prescribed documents attached

Contract Negotiation

  • Liaise with you on any request for amendments to the contract and special conditions that you may require
  • Cooling off period if applicable

We Receive Check And Exchange The Contract

Exchange Contracts

  • Ensure all terms agreed to in both copies of the contract
  • Arrange for you to sign the contract
  • Arranged for the deposit to be invested with a financial institution

Post Exchange

  • Arrange for discharge of mortgage if applicable
  • Respond to requisitions on title
  • Have you sign the transfer
  • Arrange settlement figures and have them agreed to by the other party
  • Book settlement with the bank and purchaser’s conveyancer or solicitor
  • Arrange any payment of Land Tax if necessary

Settlement and Post Settlement

  • Attend settlement and hand over all required documents
  • Arrange for the deposit money to be released 
  • Provide documentation of the transaction for your records
  • Records are Stored on file and can be obtained from us for 7 years after settlement of your property
